LIFE SCIENCE INVENTIONS - this question not only challenges patent law, but also involves other disciplines of law closely connected to patent law. Lately, patent rights to life science inventions have been in focus in the debate. However, several related legal issues in the complex context of research and development of pharmaceuticals, and the following commercialization of these drugs, challenge the law. By examining the various aspects of inventions in this field, the author shows the complexity and develops a comprehensive understanding of legal issues affecting the players in the life sciences field.

The text explores modern patent law issues with a focus on the patentability of stem cells and research tools in Europe and the U.S. The book then adds an understanding of ethics within the European patent law and the access issues surrounding these kinds of inventions. Other questions include the unfair competition and antitrust claims that recently have come into play in this context and ownership of biological material. The book ends with the various aspects surrounding market authorisation with respect to infringement and unfair competition and sums up with a comprehensive analysis of the stem cell and research tool issues.

LIFE SCIENCE UPPFINNINGAR – denna fråga sätter inte bara patentlagstiftningen på prov utan involverar även andra närliggande juridiska discipliner. Debatten har på senare tid fokuserats på patenträttigheter avseende uppfinningar inom området för life science. Flertalet relaterade juridiska frågor inom den komplexa kontexten av forskning och utveckling av läkemedel har emellertid även de satt juridiken på prov. Genom att analysera de olika aspekterna avseende uppfinningar inom detta område visar författaren på komplexiteten samt utvecklar en allomfattande förståelse av de juridiska frågor som påverkar aktörerna inom området för life science.

Texten utforskar moderna patentlagsfrågor med fokus på patenterbarhet av stamceller och analysredskap i Europa och USA. Boken tillför sedan en förståelse för etik inom Europeisk patentlagstiftning och frågor om nyttjandemöjligheter som omger denna typ av uppfinningar. Andra frågor inkluderar marknadsrättsliga och antitrustkrav som på senaste tiden har fått betydelse i denna kontext samt äganderätt till biologiskt material. Denna bok avslutas med de olika aspekter som omgärdar marknadsgodkännande avseende intrång och marknadsrätt och sys ihop genom en grundläggande analys av stamcells- och analysredskapsfrågan.

Författarpresentation

Li Westerlund holds a Doctor of Laws in Biotech Patents and has published books and several articles and chapters in the patent-legal and related fields. Dr. Westerlund is practicing law at the Swedish law firm RydinCarlsten in Stockholm, focusing primarily on the life sciences field and specifically on patents. Dr. Westerlund is also a U.S. attorney-at-law. Her previous positions include working at the biotech patent group at McKenna Long & Aldridge, LLP, Washington DC, and at the Court of Appeals for the Federal Circuit.

Dr. Westerlund är verksam jurist vid den svenska advokatbyrån RydinCarlsten i Stockholm och fokuserar huvudsakligen på life science-området och särskilt på patent.
